Trademark Registration is the legal process of securing exclusive rights to a trademark, granting the owner protection over its use for specific goods or services. Once registered, the trademark holder can prevent others from using identical or confusingly similar marks, helping to establish brand identity and protect intellectual property.
Trade Mark means any symbol capable of differentiating the goods and services from those of other enterprise. In India, Trademark is protected under the Trademark Act, 1999. The registered trademark is effective for a period of 10 years from the date of filing of the application. Amongst other IP rights, trademark is not a perishable right as it can be renewed from time to time in accordance with the provision of the Act.
Apart from the National Law of different countries, there are international agreements/arrangements which protect the trademark within its member Countries in single application. e.g. Registration of Community Trademark under which the protection is granted for 27 countries, International registration of trademark under Madrid Agreement / Protocol which facilitates the registration process within its 81 member countries and European Community.
