Trademark Opposition/ Cancellation

Trademark opposition means an objection filed by third parties against the registration of a trademark within 4 months of the notice of opposition of the trademark. Whether natural or legal, any person may file an objection with the Registry, including any individual, corporation, a partner company, and trust.

Whereas, Trademark cancellation is a legal process in which an aggrieved individual or group tries to remove a registered trademark from the list. If a wrong trademark aggrieves a person on the trademark register, he is entitled to file a petition to cancel registration or correction of the registered trademark register. In the event of cancellation of a registered trademark, the party concerned may request cancellation of the trademark either within 5 years of registration of the trademark or within 5 years of subsequent registration.
